🍲 Starting a home-based catering business in Chicago, IL: which licenses and registrations do I need?

Kenneth wrote: β€œI sell BBQ from my home-based catering business.”

Hi Kenneth, a home-based catering business in Chicago is a promising idea. Catering lets you cook in batches, plan your schedule, and grow from a few trays to full events as word of mouth spreads. Because you want to protect your personal assets, limit exposure from sales, clients, employees, or debt and look more credible to customers and banks, we start with the LLC and build everything else around it. Below we walk through the three things every new business in Illinois sorts out (structure, tax IDs, and licenses) and then sum it all up.

Selling barbecue in Chicago is a mouthwatering plan with a hard rule underneath it: meat is not allowed under home-kitchen exceptions that cover cookies and bread in Illinois, so you generally have to cook in a licensed commercial kitchen. A shared commissary kitchen is the usual workaround, and many caterers rent time there by the hour. A smoker also draws attention from neighbors and building rules, so confirm where you can legally fire it up. Once you serve the public you will need a food license and proof of food safety training, and catering events can add their own requirements. An LLC protects your home if a guest gets sick, and good insurance matters even more. What your home-based catering business needs LLC (limited liability company) – Forming an LLC puts a legal wall between the business and your personal assets. If guests at a wedding get sick from a tray of chicken salad, an LLC keeps the claim against the business and away from your house. Once profits grow, an LLC can elect S corporation tax treatment, which can lower self-employment tax; ask a tax adviser when the numbers justify it.DBA (doing business as) – If you plan to operate under a brand name instead of your own name or your LLC's exact name, register that name first.EIN (federal tax ID number) – Think of the EIN as a Social Security number for the business: banks, suppliers, and clients who send you tax forms will all ask for it.Illinois sales tax registration – You will be selling taxable goods, so register to collect sales tax before your first sale. It also lets you buy inventory for resale without paying tax on it.Business license – Most places require a local business license to operate, including home-based businesses. Check the rules where your home-based catering business will operate in Chicago, and ask about home occupation and zoning rules if you work from home. If you rent, many permits ask for the landlord's written consent to run a business from the property.Cottage food or home kitchen permit – Rules vary widely: many states limit home kitchens to shelf-stable items, while some now allow small home-based meal operations with a permit.Food permit and commercial kitchen – For full meals in most states, you will need a permitted commercial kitchen or a rented commissary space.Food handler or manager certification – Expect at least one person on your team to hold a food safety certificate.

By the numbers: Banks, insurers, and tax forms will ask for your industry code. For a home-based catering business it is NAICS 722320 (Caterers). That makes 8 items on your list.

Tip: Use a written catering contract that covers headcount, deposits, and cancellations so payment questions never become arguments.

To recap: Your home-based catering business in Chicago, IL needs an LLC, a DBA if you use a brand name, an EIN, a sales tax permit, a business license, cottage food or home kitchen permit, food permit and commercial kitchen, and food handler or manager certification. Handle these early and the business starts on solid ground.

I’m wanting to start my own food business and not sure where to begin. Hot dog vending carts selling hot dogs. What type of business license do I need for a food truck in Memphis, TN?

Answer:

Hi William, we can help you register for our Food Service in Hammond, Boone County, IN. The EIN is required but also some other licenses as described below:

First,
thing to do is the entity tax structure selection. There are 4 main types of tax entity business structures, namely, sole proprietor, LLC , Partnership or Corporation.

You need to select one because you will be taxed as the entity type you select and also, the rest of the documents, such as the seller's permit, will be registered under the entity you chose.
Since you are in a very risky business (for example, you can cause food poisoning and be subject to lawsuits), it is a good idea to incorporate or form an LLC , so you can be protected from personal liability.
That said, keep in mind, you cannot be the sole proprietor and file a seller's permit as an LLC unless you obtain an LLC certificate.
In your case, since you showed an interest that you prefer an LLC , then form an LLC .

Second,
Because Food Service is subject to sales tax, you will need to obtain a seller’s permit. So, for example, if you sell Food at $5, you need to charge tax. If the tax is 10%, then you need to charge the client $5.50 for the food.
The sales tax rate for most states ranges from 4% to almost 10%.
Third,
Furthermore, note that all businesses need to obtain a business license. There are several reasons that you need a business license, but in your case, the main reason is that part of the business license is the health permit that is in the inspection you get once you apply to obtain a business license.

Finally,
If you hire food waitresses and other personnel, you will need to obtain a federal and state EIN as well, so you can pay federal and state withholding employment taxes.

Good morning, I would like to know how do I obtain a license to buy food wholesale? I am planning to sell simple organic superfoods and drinks from a van - what licensing do I need for vendor Encinitas CA and for food in general? How to get a food license?

All businesses need at least 2-5 business registration, so you will still need other registrations, such as licenses, an assumed business name DBA, and tax IDs as described above.

In addition, even one person, sole owner/proprietors working from home or just online can form an LLC or incorporate, in which case, they will not need to file a DBA, and they will be members of the LLC .

Selling food requires that you get a seller's permit because you will need it to buy the food items wholesale and sell them retail.

For instance, you can buy your food prepared items tax-free and when you serve and sell food, you will also need the permit to charge taxes.

For example, if a type of super food you sell sells for $15 and the sales tax rate is 10%, you will have to collect an additional $1.50 for sales tax, so the total in this case would be $16.50.

Q:
Yes, I was trying to find out if I needed a permit to sell at a smiley's flea market in Macon GA.

A:
Yes, for flea market, you will need all licensing including a business license and a seller's permit.

Q:I will be selling food. I'm trying to sell platters of food out of my house in the summer what do I need and can I get these things for free.
A:
You need all licensing as described on this site. We charge a fee for our service, but we have a coupon you can use to get a discount.

If you decide to be a sole proprietorship instead of an LLC , and trade name is a business name other than your full personal legal name, you will need to file a Doing Business As (DBA) Certificate.

For instance, your name is John Doe, and you do business as Best Items By John, the name must be registered with a DBA Biz Name document called a DBA certificate because Best Items By John, is not your full legal name.

REQUIRED LLC LIMITED LIABILITY DOCUMENTS AND LICENSES
LLC Refers to the Legal Company Structure

The Food Service legal structure is selected during business registration. If you choose to be an LLC , you do not need to file a Doing Business As (DBA) Certificate. About 60% of new businesses select an LLC when choosing a corporate structure. For example, if you are the Food Service sole owner, you can file a DBA and so select the sole proprietorship structure or select the LLC structure to be a corporate entity because LLC afford corporate protections such as business and personal liability protections.

Thus, when starting a business whether an online, home, store, concession stand or a mobile cart, you will need to first select among sole owner/proprietor, partnership, LLC or corporation, all of which also require a General Food Service Business License (not a specific license to your type of business, necessarily but a requirement for LLC companies as well as necessary) for any business as well.

If you decide to be a sole proprietorship instead of a Food Service LLC , and the trade name is a business name other than your full personal legal name, you will need to file a Doing Business As (DBA) Certificate. For instance, if your name is John Doe, and you do business as Best Food Service Items By John, the name must be registered with a DBA Biz Name document is called a DBA certificate because Best Items By John is not your full legal name.

Also, note that whatever item that you sell or lease, and it is an item that can be touched (i.e., tangible items such as equipment, toys, merchandise, electronics, prepared food) requires a state sales tax ID (Sellers Permit) to either buy or sell the items or wholesale and sell them in retail. If you or your LLC are hiring workers within the next 30 days, you will need a Federal EIN and a State EIN (employer identification number).

Even if you treat the LLC as a disregarded entity, you can use your social security to conduct business, it is not recommended. Other instances that you will need a federal tax ID: if you are a partnership, an independent contractor, and a corporation or an LLC treated as a corporation. You can also obtain a federal tax ID as the sole proprietor and use it as a business tax ID in place of a social security number.

However, all Food Service businesses need at least 2-5 business registrations, so you will still need other registrations, such as licenses, an assumed business name DBA, and tax IDs as described above. Finally, even one person, sole owner/proprietors working from home or just online can form an LLC or incorporate, in which case, they will not need to file a DBA, and they will be members of the LLC .

Q:Is "piercing the corporate LLC veil same as in corporations case?
A:Piercing the corporate veil refers to the corporate protection that an LLC affords so long as you treat it as a separate legal entity. If you don't, you pierce the veil and you lose the protection so you become liable as if you were a sole proprietor.
LLC Q:Are there compliance obligations for LLCs?.
A:You may have to file a statement of officers each year for an LLC?.
Q:How do I attract and sign up more LLC member investors?

Q:How can I find out what licensing is required for my LLC?
A:Got to www.GetFreeLLC.com for business licensing information.
Q:What is the difference between an LLC and a corporation?.
A:Both an LLC and a corporation are corporate entities that afford corprate protections. An LLC however can have more owners and also foreign owners. In addition an LLC is taxed pass-through like a sole owner or partnership unless it elects to be a corporation?.
LLC Q:Are there any tax savings in forming an LLC in Delaware?
A:Delaware saves you taxes because there is no sales tax and you don't have to get a business license if your business is located in another state. Nor is there any LLC income tax as in Nevada.
Q:Becoming an llc or a corporation is probably the cheapest insurance and a good way to save on taxes using several available strategies to reduce your tax liabiltiy but can one person be an LLC?.
A:Yes you can form an LLC even if you are one person with little or no capital reserves..
Q:How do I provide proof that I own an LLC?

Q:How many people do I need to form an LLC?
A: Even just one person can form an LLC.
Q:How do I file an LLC?
LLC A: The creation of an LLC occurs when the articles of organization are recorded. You need to fill out the certificate and file it. Normally a state fee is involved and the llc may have to be published in some states. Other than that you just need an LLC agreement and you will be an LLC.
Q:How will I have to pay for taxes for my LLC?
A: With an LLC, you can elect to be taxes as a sole owner or be taxed as a corporation.
Q:   What are the differences between a limited liability company and a partnership?
A:The important difference between an LLC and a general partnership is that the LLC affords protection as a corporation does so you are not personally liable for business debts as is the case with a partnership.
Q:What do I need to know before I set up an LLC?
A:You may want to look into securities law if you are a passive investor in the LLC because you may have to register the sale of membership certificates with the SEC.
Q:Do I need to sign the LLC certificate of the articles of organization before you submit it to the secretary of state?
Seller's Permit A:No, you don't need to sign the articles before we submit it for filing.
Q:What state is the best state to set up an LLC?
A:Unless you make more than 100
Q:Why do they call it pass-through taxation?
Business License A:Pass-through taxation means that you can report the llc income through your individual tax return. This allows you both to offset personal losses against llc profits as well as avoid double taxation.
Q:What if I want my LLC to be taxed as a C corporation?
A:In some cases you may want to be taxed as a corporation and it may result in savings because corporate taxation is lower than individual taxation.
Q:In what states may I set up a series LLC?.
A:Delaware, Illinois, Iowa, Nevada, Oklahoma, Tennessee, and Utah allow for series LLCs.

I need advice on business insurance, finding investors, a website and advertising for my record label. Does the LLC service include the state fee and an operating agreement?
10/14/2026 5:04 AM

For a record label, an LLC is the right base. You handle artists' contracts, royalties and releases, and the LLC separates any dispute from your personal assets. The state's filing charge is shown apart from our service fee on the order page, and the operating agreement is prepared with your LLC, so your bank can open the account.

• Insurance: ask an insurance agent about general liability and media liability for a label, plus coverage for equipment.
• Investors: they usually want a formed LLC, an operating agreement and clean books first, then a clear plan for how their money is used.
• Website and advertising: register the name and open the bank account before you spend on promotion.

A surety bond is not what you need. Insurance protects you from claims, while bonds guarantee performance in certain regulated trades.

Do I need an LLC and a tax ID if my items are not taxable in my state? I also need to register a business at an address in Georgia.
10/14/2026 5:04 AM

Yes, an LLC still makes sense even when your products are not taxable. Taxability is only about sales tax, while the LLC is about protecting your personal assets from product and customer claims, and about credibility. With investors in mind, a formal company is what they will want to see.

On the tax ID, you still need an EIN for banking and federal taxes, since that is separate from sales tax. A seller's permit may not be needed if everything you sell is exempt, but many suppliers and marketplaces still ask for one, so check with them. Health and beauty products can be taxable in other places, so check where you sell.

For the Georgia address, I cannot supply an office location. Register the business at the real place where you operate, or use a registered agent's address for state papers. A local business license depends on that location.

I live in New York and want to start a mobile petting zoo. I also want to sell gift baskets by taking the order and having a company ship it. What do I need, and can I charge sales tax?
10/14/2026 5:04 AM

A mobile petting zoo carries real risk, since children and animals mix and a bite or a fall could lead to a claim. An LLC is the proper vehicle, because it separates that exposure from your personal assets, and it can bring in investors. A foreign owner is fine for an LLC.

• Petting zoo: animal exhibits are regulated, so expect animal health paperwork, permits for events, and liability insurance that venues will ask for.
• Business license, locally, plus approvals for each event location.
• EIN, for banking and taxes.

For the gift baskets, to charge sales tax you need a seller's permit, which in New York is registered as a certificate of authority. Even if you never touch the product or the money, if you take the order and your company is the seller, you generally must be registered to collect tax. If the other company is the seller of record, it may handle that, so clarify who sells.

How long does it take to get a reseller's permit in New York with expedited service? I do not have a certificate of authority for my LLC. I also have questions about zoning for a home inspection business.
10/14/2026 5:04 AM

In New York, the sales tax registration is called a certificate of authority, and a reseller's permit is built on it, so you do need one for your LLC. We can file it with expedited handling, which moves faster than standard processing, but I cannot promise a specific number of days because timing depends on the application.

Home inspection is a service, so the permit matters mainly if you also sell products or tools that are taxable. Your LLC fits the business well: inspectors face claims when something is missed, and the LLC separates those from your personal assets.

• Zoning: a home office is usually allowed, but you do not need a vote from the town council in most cases. Ask locally whether a home occupation approval applies.
• Professional license: home inspectors are licensed in many places, so confirm before you take clients.

File the certificate of authority well before your first sale, since New York asks that you register in advance.

What license do I need to buy seafood in Louisiana, transport it to Tennessee and sell it to restaurants and the public, and do I need a wholesale license?
10/14/2026 5:04 AM

Form an LLC before anything else. Moving fresh shrimp and other seafood across state lines involves spoilage, illness and vehicle risks, and the LLC protects your personal assets while showing restaurants that they are dealing with an established company. A foreign owner can hold an LLC, too.

• EIN, for the account, payroll and supplier accounts.
• Seller's permit: it works as your wholesale and resale registration, so you can buy without tax and sell with tax. You may need one wherever you sell.
• Seafood dealer permit: seafood is regulated at each step, including buying, cold storage and delivery, so ask where your product is sourced and sold.
• Business license, locally.

Whether you open a fish market or a restaurant, each needs its own food permits and inspections.
